This Legal Notice governs the use of the website www.vionnutrition.com (the "Website"). It is published in compliance with Article 10 of Spanish Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce ("LSSI") and equivalent transparency obligations under EU and international law.

DAILYHEALTH SL is the owner, operator and host of the Website. Hosting infrastructure is provided by Shopify Inc. as our service provider.

2. Purpose of the Website

The Website is the official online point of presence of the VION brand. Through it, you may:

•   Discover information about VION products and services;

•   Create and manage a customer account;

•   Place pre-orders and orders for VION products;

•   Read our policies and corporate information;

•   Contact our team.

Use of the Website is voluntary and free of charge for browsing. The purchase of products is governed by our Terms of Service and related policies.

3. Acceptance and proper use

By accessing the Website, you ("the User") acquire that condition and agree to use the Website in accordance with this Legal Notice, the Terms of Service, the Privacy Policy and any applicable law.

You undertake to:

•   Use the Website lawfully, in good faith and with respect for public order, accepted standards of conduct and the rights of third parties.

•   Not introduce viruses, malware, scripts or any other code that may damage, disable, overburden or impair the Website or its underlying infrastructure.

•   Not use the Website for purposes that are illegal, deceptive, harmful or contrary to the legitimate interests of DAILYHEALTH SL, our customers, partners or any third party.

All content of the Website — including but not limited to texts, photographs, illustrations, graphic design, source code, software, databases, audio, video, logos, brand names, product names, slogans, trademarks and trade dress — is owned by DAILYHEALTH SL or its licensors and is protected by Spanish, European Union and international intellectual property and industrial property laws.

The names "VION", "Vionnutrition", the VION logo, packaging, product photography, the design of the VION smart device and any related visual identity are trademarks and/or industrial designs of DAILYHEALTH SL.

Access to the Website does not grant you any right of ownership, license or authorisation to reproduce, distribute, publicly communicate, transform or commercially exploit any of the content, except for the limited, personal and non-commercial use strictly necessary to browse the Website. Any other use requires the prior written consent of DAILYHEALTH SL or the relevant rights holder.

5. Liability for content and availability

DAILYHEALTH SL applies reasonable diligence to keep the content of the Website accurate, complete and up to date. However, the Website may contain inaccuracies, omissions or out-of-date information. To the maximum extent permitted by law:

10. Governing law and jurisdiction

This Legal Notice is governed by Spanish law, without prejudice to mandatory consumer protection law of your country of residence which may grant you stronger rights.

For consumers resident in the EU, EEA or UK, any dispute relating to the use of the Website may be brought before the courts of your place of residence within the EU/EEA/UK, or alternatively before the courts of A Coruña, Spain.

For all other Users and disputes, the courts of A Coruña, Spain shall have exclusive jurisdiction, except where mandatory consumer protection law in your country of residence imposes otherwise.
