Return and Refund Policy

This Return and Refund Policy ("Policy") governs all purchases of VION products made through vion.health and any other authorised online store operated by DAILYHEALTH SL.
VION is the commercial brand operated by DAILYHEALTH SL, a Spanish limited liability company (Sociedad Limitada) with tax identification number B72489370 and registered office at Calle San Andrés 139, 10º D, 15003 A Coruña, Spain ("VION", "we", "us", "our"). Although you purchase under the VION brand, your invoice and payment statement will display DAILYHEALTH SL as the merchant of record.

1. Scope and definitions
This Policy applies to all consumer purchases of VION products, including:
• The VION smart device (also called "the device" or "the dispenser");
• VION cartridges and capsules (Core, Boost, Adapt or any future supplement formulation);
• The at-home blood test kit included in selected tiers (e.g. VION VIP);
• Any accessories or add-ons sold under the VION brand.
For the purposes of this Policy:
• "Order" means any purchase confirmed by an order confirmation email from VION.
• "Pre-order" means an order placed before commercial release, with shipment expected during the Q4 2026 window (October – December 2026) or any extension expressly accepted under Section 6.
• "Consumer" means a natural person purchasing for personal, non-professional use.
• "Business day" means Monday to Friday, excluding public holidays in Spain.
This Policy must be read together with our Terms of Service and Privacy Policy. In case of conflict, the mandatory consumer protection law of your country of residence prevails.
2. Important pre-order notice — please read before purchasing
You acknowledge and accept that:
1. VION is currently sold as a pre-order. The current estimated shipping window is Q4 2026 (October – December 2026). This window is an estimate, not a guaranteed delivery date.
2. Pre-order delays may occur for reasons including manufacturing, certification, logistics, supplier availability or force majeure. If a delay occurs, Section 6 of this Policy describes your rights in detail.
3. Your right to a full refund is fully preserved at all times during the pre-order phase (see Section 3) and at the end of any extended waiting period (see Section 6).
4. Capsules, cartridges and the at-home blood test kit are health-related consumables. Once their hygienic seal is broken, they cannot be returned for safety reasons (see Section 10). The 14-day right of withdrawal under EU law expressly does not apply to such opened items.
5. The smart device is covered by a legal warranty of 2 years (EU/EEA/UK) or 1 year (USA and rest of world) as described in Section 9.
6. By placing a pre-order, you confirm you have read and accepted this Policy.
3. Pre-order cancellation (before shipment)
You may cancel any pre-order at any time before it has been dispatched, free of charge and for any reason.
How: Send an email to info@vionnutrition.com from the email address you used at checkout, including your order number and the wording "Cancel pre-order".
Refund: We will issue a full refund of the amount paid, including any shipping fees charged at checkout, within fourteen (14) calendar days of receiving your cancellation request. Refunds are issued to the original payment method.
This right of pre-shipment cancellation is in addition to, and independent of, the legal right of withdrawal described in Section 4.
4. Right of withdrawal (EU / EEA / UK consumers) — 14-day cooling-off period
If you reside in the European Union, the European Economic Area or the United Kingdom and purchase as a consumer, you have the legal right to withdraw from your purchase without giving any reason within fourteen (14) calendar days from the day on which you (or a third party indicated by you, other than the carrier) acquire physical possession of the goods.
This right is granted under Directive 2011/83/EU (Consumer Rights Directive) and, in Spain, by Articles 102 et seq. of the consolidated text of the General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007, "TRLGDCU"). UK consumers benefit from equivalent rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
4.1. How to exercise your right of withdrawal
To exercise this right, you must inform us by an unequivocal statement before the 14-day deadline expires. You may use any of the following channels:
• Email: info@vionnutrition.com, with the subject line "Withdrawal — Order #[your order number]".
• Postal mail: DAILYHEALTH SL — Returns, Calle San Andrés 139, 10º D, 15003 A Coruña, Spain.
• The model withdrawal form provided in Annex I of this Policy (optional).
The withdrawal deadline is met if you send your communication before the 14-day period has expired.
4.2. Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including the standard delivery costs (except for any supplementary costs resulting from a more expensive type of delivery you chose), without undue delay and no later than 14 calendar days from the day on which we are informed of your decision to withdraw.
We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent them back, whichever is the earliest.
We will use the same means of payment used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will incur no fees as a result of the reimbursement itself.
4.3. Return of goods
You must send the goods back, or hand them over to us, without undue delay and in any event no later than 14 calendar days from the day on which you communicate your withdrawal.
The direct cost of returning the goods is borne by you (the customer), in accordance with Article 14(1) of Directive 2011/83/EU. We recommend using a trackable shipping service; we are not responsible for items lost in return transit.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
4.4. Statutory exceptions to the right of withdrawal
In accordance with Article 16 of Directive 2011/83/EU and Article 103 TRLGDCU, the right of withdrawal does not apply to:
• Sealed goods which are not suitable for return for reasons of hygiene or health protection if their seal has been broken after delivery — this includes opened or unsealed VION capsules, cartridges and at-home blood test kits.
• Goods made to the consumer's specifications or clearly personalised — this includes personalised supplement formulations prepared based on your biomarker data, lifestyle questionnaire or wearable data once such personalisation has been started.
• The supply of digital content not on a tangible medium where performance has begun with your prior express consent and acknowledgement that you thereby lose your right of withdrawal — this includes AI-generated personalisation reports already issued to you in the VION app.
You will be informed of these exceptions again at checkout, and your acknowledgement will be recorded.
4.5. Goods you may return under the cooling-off right
You may exercise the 14-day right of withdrawal for:
• The VION smart device, provided it is returned in its original packaging, with all accessories, in resaleable condition.
• Sealed, unopened capsule packs, cartridges and blood test kits.
5. Cooling-off / return window for non-EU customers (including USA)
Customers outside the EU/EEA/UK do not benefit from a statutory cooling-off period under EU law. As a goodwill commercial gesture, VION grants you a 14-day return window from the date of delivery, subject to the same conditions and exceptions as Sections 4.3 and 4.4.
This goodwill window does not override any mandatory consumer protection rights you may have under your local law, including the consumer protection laws of your U.S. state of residence.
6. Shipping delay protocol — Q4 2026 + 3-month grace period
This Section is the core pre-order protection. It applies to all orders, regardless of country of residence.
6.1. Estimated shipping window
VION products are sold as a pre-order with an estimated shipping window of Q4 2026 (October – December 2026). We will keep you informed by email of progress milestones.
6.2. Initial 3-month grace period
If we are unable to ship your order before 31 December 2026:
• A grace period of up to three (3) additional months will automatically apply (i.e. up to 31 March 2027).
• We will notify you by email at the start of this grace period explaining the cause of the delay and the new estimated ship-by date.
• During this grace period, you remain entitled at any time to cancel your order under Section 3 and receive a full refund.
6.3. End of the 3-month grace period — your two options
If, at the end of the 3-month grace period (i.e. on 31 March 2027), your order has still not been shipped, we will email you with a clear choice:
Option A — Full refund You receive a full refund of the amount paid, including any shipping fees, processed within fourteen (14) business days of your request, to your original payment method.
Option B — Continue waiting You agree to wait until the new shipping window we communicate to you. We will provide a specific revised estimated ship date in the same email. By choosing Option B you do not waive any right — you may switch to Option A at any later moment by emailing info@vionnutrition.com, until your order has been dispatched.
6.4. What happens if you do not respond
If you do not respond to our notice within thirty (30) calendar days, you will be deemed to have chosen Option B (continue waiting).
This default is intended to avoid unilateral cancellation of customers who wish to keep their pre-order. You retain the right to request a full refund at any time afterwards, until your order is dispatched, by emailing info@vionnutrition.com.
6.5. No automatic forfeiture of refund right
Nothing in this Section 6 shall be interpreted as a waiver of your statutory right to a refund under EU consumer law, Spanish law or any other applicable mandatory consumer protection law.
6.6. Force majeure
In the event of force majeure (events outside our reasonable control, including but not limited to natural disasters, pandemics, war, government action, regulatory changes, fundamental supplier failure or transport infrastructure collapse), the timelines in this Section may be extended for the duration of the force majeure event. We will inform you transparently and your right to a full refund remains preserved at all times.
7. How to start a return or refund
To initiate any return, withdrawal or refund:
1. Email info@vionnutrition.com from the email address you used at checkout.
2. Include: order number, full name, reason (optional, except for warranty claims), and indication of which Section of this Policy you are invoking (e.g. "Section 4 — withdrawal", "Section 9 — defect", "Section 6 — pre-order delay").
3. Wait for our reply within 5 business days. We will provide a Return Authorisation (RA) number, the return address (which may differ from our registered office), and packaging instructions.
4. Ship the product back within 14 calendar days of receiving the RA number, at your expense (except where Section 9 applies — defective products). Use a trackable carrier and keep the tracking number.
5. We inspect the product within 5 business days of receipt and confirm refund or replacement by email.
Returns shipped without a Return Authorisation number will not be accepted and will be returned to sender at sender's expense.
8. Refund timing and method
Once your return is approved, refunds are issued:
• To the original payment method used at checkout (credit/debit card, PayPal, Apple Pay, Google Pay, Shop Pay or other).
• Within 14 calendar days of approval (Sections 3 and 4) or within 14 business days for Option A under Section 6.
• In the original currency charged at checkout. We are not responsible for fluctuations in your bank's exchange rate between the date of charge and the date of refund.
If you do not see the refund after 14 days, first check with your card issuer or payment provider; their internal processing can add up to 10 additional business days. If it still has not arrived, contact us at info@vionnutrition.com.
9. Defective, damaged or non-conforming products — legal warranty
9.1. Smart device — legal warranty of conformity
The VION smart device is covered by a legal warranty of conformity:
• 2 years for consumers residing in the European Union, the European Economic Area or the United Kingdom (Directive (EU) 2019/771; in Spain, Articles 114 et seq. TRLGDCU).
• 1 year limited warranty for consumers residing in the United States and the rest of the world.
The warranty period starts on the date you receive the device.
9.2. What the warranty covers
We will repair or replace, free of charge, any device that:
• Was defective at the moment of delivery;
• Develops a manufacturing or material defect during the warranty period under normal, intended use;
• Does not match the description, characteristics or functionalities communicated to you at the time of purchase.
If repair or replacement is impossible, disproportionate or fails, you are entitled to a price reduction or full refund as provided by applicable law.
9.3. What the warranty does NOT cover
• Damage caused by accident, misuse, negligence or unauthorised modification;
• Damage from use of liquids, capsules or cartridges not authorised by VION;
• Normal wear and tear of consumable parts;
• Cosmetic damage that does not affect functionality;
• Damage caused by failure to follow user manual instructions.
9.4. Capsules, cartridges and blood test kits — defects on arrival
If your capsules, cartridges or blood test kit arrive damaged, expired, with a broken seal upon receipt, or fail to function as described:
• Notify us within 14 calendar days of receipt by email at info@vionnutrition.com, including photographs of the defect and the batch number printed on the packaging.
• We will replace the affected items free of charge or, at your option, refund their value.
• Return shipping costs for defective items are paid by VION (we will provide a prepaid return label or alternative arrangement).
9.5. USA — Magnuson-Moss disclaimer
For consumers in the United States: the limited 1-year warranty described above is the only express warranty provided by VION. To the maximum extent permitted by law, all implied warranties (including merchantability and fitness for a particular purpose) are limited in duration to the express warranty period and are subject to the limitations stated in this Policy. Some U.S. states do not allow such limitations on implied warranties or the exclusion of incidental or consequential damages, so the above may not apply to you.
This Policy gives you specific legal rights, and you may also have other rights that vary from state to state.
10. Non-returnable / non-refundable items
For health, safety and personalisation reasons, the following items are never refundable once delivered, except where defective under Section 9:
• Capsules, cartridges or supplement packs whose hygienic seal has been broken (Article 103(e) TRLGDCU and equivalent EU provisions).
• At-home blood test kits whose sealed packaging has been opened or whose collection has been started.
• Personalised supplement formulations prepared specifically for you based on your biomarker, questionnaire or wearable data (Article 103(c) TRLGDCU), once preparation has begun with your express consent.
• AI-generated personalisation reports, recommendations or analyses already delivered through the VION app, once you have accessed them with prior express consent and acknowledgement that this terminates the right of withdrawal (Article 103(m) TRLGDCU).
• Gift cards and digital vouchers, except where required by mandatory law.
This list is consistent with Article 16 of Directive 2011/83/EU and Article 103 TRLGDCU.
11. USA-specific provisions
If you reside in the United States:
• Section 5 (goodwill 14-day return window) applies, subject to the same exceptions as Section 4.
• The limited warranty in Section 9 is governed by the Magnuson-Moss Warranty Act and the consumer protection laws of your state of residence.
• Nothing in this Policy limits your statutory rights under the laws of your state of residence, including (without limitation) California's Consumers Legal Remedies Act and Song-Beverly Consumer Warranty Act, New York's General Business Law §349, the Texas Deceptive Trade Practices Act, or equivalent provisions in other states.
• Disputes shall be resolved as set out in Section 12 below.
12. Governing law, dispute resolution and contact
12.1. Governing law
This Policy is governed by Spanish law and applicable European Union consumer protection law, without prejudice to the mandatory consumer protection law of your country of residence which may grant you stronger rights.
12.2. Jurisdiction (consumers in the EU/EEA/UK)
Any dispute arising out of or relating to this Policy may be brought before the courts of the consumer's place of residence within the EU/EEA/UK, or alternatively before the courts of A Coruña, Spain.
12.3. Online Dispute Resolution (EU)
If you are a consumer resident in the European Union, you may also use the European Commission's Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr.
12.4. Spanish consumer arbitration
In Spain, you may also submit any consumer dispute to the Sistema Arbitral de Consumo if available for the matter at hand.
12.5. Jurisdiction (consumers outside the EU/EEA/UK)
For consumers outside the EU/EEA/UK, including the United States, this Policy is governed by Spanish law without regard to its conflict-of-laws rules. Disputes shall be submitted to the exclusive jurisdiction of the courts of A Coruña, Spain, except where the consumer protection law of your country of residence imposes otherwise.

13. Updates to this Policy
We may update this Policy from time to time to reflect changes in our practices or in applicable law. The version in force at the time you place your order is the one that applies to your contract. We will display the "Last updated" date at the top of this Policy. Material changes will be notified by email to active customers.
